Weddings Terms and Conditions

When placing an order with Cake Palate Designs, LLC® (hereinafter “Me”, My”, “I”, "We", "Us", "Our", “Cake Palate Designs, LLC”) you (hereinafter “You”, “Your”, “Customer”, “Client”) agree to the following Wedding Terms & Conditions:

Contractual Agreement

Your signature or payment on your contract establishes a legally binding agreement between you and Cake Palate Designs, LLC. Cake Palate Designs, LLC reserves the right to decline to provide our goods or services to a customer. It is our policy to comply with all applicable state and federal laws prohibiting discrimination in employment based on race, age, color, sex, religion, national origin, disability, or other protected classifications.

Scheduling - Wedding cakes require a minimum of three (3) months' notice. I strongly encourage booking at least one year in advance, or as soon as you know your date. The wedding season is (April-October), and those dates are in high demand. Peak season is May, June, September, and October therefore, any price quote will be kept on file for three (3) months unless the order is booked during the consultation. To maintain a high level of personal service and quality, I only accept a limited number of weddings and special events each week, or weekend.

 

Date Hold – A non-refundable $100.00 retainer is required to reserve your event date if you are not placing a wedding cake order. The retainer will be applied towards the balance of the cake order if you book with Cake Palate Designs, LLC. All dates are reserved on a first-come, first-paid basis. Until you pay a retainer or deposit your date is not secured, and it is still available for other customer reservations. A signed contract and a deposit of 50% of the order total are due within 30 days of paying your retainer. The remaining balance of your signed contract is due 60 days before the wedding. After a 30-day date hold, unless a deposit or payment in full accompanied by a signed contract is received, your retainer is forfeited, and your date is no longer guaranteed.

Wedding Consultations – These are 45-minute complimentary consultations conducted in person or by Zoom. I also offer, "To go" cake-tasting boxes for pickup, or delivery (delivery charges apply) to conduct the consultation at your leisure. For all wedding consultations and cake-tasting appointments, there will be no refunds or future credit given for orders canceled within 10 business days of the appointment. For any cancellations, before 10 days, a credit will be given for future orders if rescheduled within 60 days. This offer is subject to the event date being available. Thereafter there will be no refunds, in-store credit, or other options to reschedule.

 

Wedding Cake Tastings – For your complimentary wedding cake consultation you can select three (3) cake flavors, three (3) fillings, and three (3) buttercreams of your choosing. This well-curated selection will allow you to experience the sophisticated quality of our cakes, as well as our unique approach to flavor and texture. We believe your wedding cake is the centerpiece of your day that reflects the style and sensibilities of your nuptials. Up to five additional cake-tasting boxes, flavors, fillings, and buttercreams can be added for an additional fee of $15.00 per box.

Gluten-Friendly and/or Vegan – For your wedding cake consultations there is a $20.00 fee to cover your tasting boxes comprised of five gluten-friendly and/or vegan cakes, fillings, and frostings of your choosing. Please note, that all Cake Palate Designs, LLC orders are made in an environment where milk, eggs, peanuts, tree nuts, chocolate, soy, sesame, wheat, and gluten products are used. My gluten-friendly and vegan cakes are baked separately with great care using sanitized equipment. However, I cannot guarantee that they will be free from all traces of the aforementioned allergens. Up to five additional cake-tasting boxes, flavors, fillings, and buttercreams can be added for an additional fee of $20.00 per box.

Allergens – All Cake Palate Designs, LLC orders are made in an environment where milk, eggs, peanuts, tree nuts, chocolate, soy, sesame, wheat, and gluten products are used. For this reason, Cake Palate Designs, LLC  cannot guarantee they are free from traces of these or other allergens. You agree to notify your guests of this risk and hold Cake Palate Designs, LLC harmless for allergic reactions. Please refer to the Allergen Disclaimer (here) for additional information.

 

Your First Anniversary – For all wedding cake orders over $500.00, I will offer a complimentary 6' anniversary cake (no customization). If you have ordered your complimentary anniversary cake, please call me a week in advance to confirm the flavor, date, and time you would like your cake ready for pickup.

Payment – We can provide cashless transactions, and I accept Affirm, PayPal, Apple Pay, Google Pay, debit cards, and all major credit cards, upon request - Zelle Pay, CashApp, or Venmo. 

 

Deposit –  For Bridal or Grooms' cake order(s), a deposit of 50% of the order total is due at the signing of the contract unless a retainer is secured. The remaining balance is due in full 60 days before the wedding. Please note that deposits are not refundable or transferable for any reason.

Invoice –  An invoice will be sent to you via email with the details of your order and due upon receipt. You have the option to pay in full or a 50% deposit. Invoices not paid within 48 hours of receipt are subject to cancellation –   I will send one invoice reminder. Your order is important. Please review the details listed thoroughly to ascertain the accuracy of your order is correct. If you find a mistake, please let me know immediately. Please call me directly— please do not email or text. All invoice discrepancy requests received by email or text will be disregarded and are not honorable.

 

Cancellations – If you cancel your order before the wedding, or before I have a chance to deliver your order to you, you forfeit the entire value of the order. Even if you pre-paid in full, or placed a partial deposit, you will NOT get a refund if you cancel your order before we have a chance to deliver it to you. When I take your event order, I begin the process of declining other orders. As I get closer and closer to your event date, the chances of re-booking your date are greatly reduced. Therefore, there will be absolutely NO REFUNDS, future credit, or date changes permitted under any circumstances. Please call me directly to cancel— please do not email or text. All cancellation requests received by email or text will be disregarded, and are not honorable.

 

Rescheduling – With advance notice and availability, if you need to reschedule your Bridal and/or Grooms cake for another date you may do so within 75 days before the date without a penalty if the contract is paid in full at the time of the rescheduling. If less than 75 days there will be a rescheduling fee of $150 to secure the new date if available since I will lose the ability to fill that vacancy on short notice. At that time if you choose to cancel you forfeit the entire value of the order, and absolutely NO REFUNDS, future credit, or date change will be permitted under any circumstances. Please call me directly to reschedule — please do not email or text. All rescheduling requests received by email or text will be disregarded, and are not honorable.

Artistry – I reserve the right to exercise artistic licensure to guarantee the structural, visual, and creative integrity of a cake or dessert structure. Custom cakes are a work of art therefore, I will not copy the work of another decorator due to copyright or trademark laws the cake(s) will be as similar as possible. I make every attempt to provide the design as requested including matching colors. Although it may not be possible to match an exact shade, I will come as close as possible. The final product may be subject to slight variations. Also, be aware that exposure to light can cause colors to change. I do not offer discounts or refunds if the exact shade of a color is not achieved, or if a variation occurs due to lighting. If a major variation needs to be made, I will communicate this to the customer and seek re-design approval.

 

Color Matching – I cannot match a “verbal” color, or a color sent via an electronic device, as all monitors display color differently. To attempt a color match, you must provide a color swatch 14 days before the event. Although I make every attempt to provide the design as requested including matching colors, it may not be possible to match an exact shade, but I will come as close as possible. The final product may be subject to slight variations. I use Cacao (Chocolate) when using black frosting to deter the aftertaste from the black dye. Please bear this in mind if you or your guest has an allergy to chocolate. For certain colors such as pink, purple, blue, or any shade of these colors I cannot and will not guarantee these colors will not fade or bleed into the surrounding colors of the chosen frosting due to the color instabilities. I suggest not leaving these cakes in sunlight for more than 10 minutes which can result in a bleached looked of that color.

 

Photographs – I reserve the right to take and use my photos of your cake(s) for marketing and promotional purposes without approval, or compensation to you. I may also request photographs from your photographer for the same purpose, and I will properly credit the photographer in my marketing (if the photographer agrees thereto). 

 

Cake Cutting – If you or your representative elects to use anyone other than Cake Palate Designs, LLC, to cut your cake, you assume all liability for the cake. We provide cake-cutting services for a $50.00 fee with delivery. We will provide you with a cake-cutting guide; it is only a guide upon request. The number of servings you get will vary according to how the person you assign cuts the cake.

 

Alterations – You agree that there will be no changes in the theme, color, or a reduction in the size of the cake order six weeks before your pickup or delivery date. You may, however, request to upgrade the order to a larger cake size with the cost difference paid in full at the time of the request. Cake Palate Designs, LLC will adjust the size of the tiers if necessary to accommodate the number of servings based on a standard industry slice one (1) inch high by two (2) inches wide and four (4) inches deep. To reiterate, we will provide you with a cake-cutting guide; it is only a guide. The number of servings you get will vary according to how the person you assign cuts the cake. You assume full responsibility if someone alters the cakes after pick up or delivery.

 

Cake Decorations – You assume full responsibility for non-edible cake décor being removed from your cake before cutting or serving. This includes but is not limited to name tags, cake toppers or any items standing on the cake, rhinestone decorations, flowers, etc. While some of these items may be made from edible materials, they may not be intended for consumption such as wires, skewers, dowels, or other items used for strength and flexibility to achieve the desired appearance of the cake(s). I strongly advise against eating décor. Be mindful of placing décor items from cakes in reach of, or near children and other guests. Potentially these items might knowingly or unknowingly be ingested. Cake Palate Designs, LLC is not responsible.

 

Damaged Cakes – Cake Palate Designs, LLC is not responsible for any damage to the cake after pick-up, delivery, or after setup is complete. We will not replace or refund damaged cakes. You are responsible for providing an appropriate and sturdy table and environment for the cake(s). If you opt to assign a designated person to pick up the cake, be sure they can lift and carry the cake and ensure there is a clean and clear space for the cake to be level set. You assume all liability and responsibility for the condition of the cake once it leaves our possession. If the cake is damaged and in need of repair, we assess a $150 damage fee if we are available. When we deliver the cake, we require someone you trust responsibly to inspect that the cake is satisfactory and sign a release waiver. Cakes are heavy and must be placed on a sturdy table and kept at an optimal room temperature of 73 degrees Fahrenheit or below. Handle all sugar paste and fondant cakes with care. Cakes with this frosting as a suggestion should be stored in a cool, dry place as refrigeration may cause colors to run or bleed, or fondant to droop. You are responsible for reading and abiding by the additional Disclaimers found (here). Acceptance of your order or a signed contract constitutes agreement.

Disclaimer – When you pay for your order, you agree that creative changes may be necessary for your final design to ensure stability and structural integrity, or in case of an emergency.

​

​Pick-ups – Pick-up is scheduled at the time of ordering Monday through Friday from 4 PM - 8 PM CST, or on Saturdays 9 AM - 1 PM CST unless other arrangements are made. We will gladly accommodate certain holidays, weekends, or Sunday orders, but a $50.00 service fee will be added to the order. If you cannot make your scheduled time, please call to reschedule. If you do not call to reschedule your pick-up time and are late, a late fee of 15% of the total order cost (excluding taxes) will be assessed and due in full at the time of pick-up. You or your designee assume all liability and responsibility for the condition of the cake once it leaves Cake Palate Designs premises. In doing so, you or your designee are hereby approving the cake's visual appearance waiving any rights to a refund based on the style, design, or visual appearance of the cake.

No Call, No-Show Orders – Any order that is not picked up is forfeited, and absolutely no refund, future credit, or date change will be permitted under any circumstances. Order(s) may be donated to charity or resold at the discretion of Cake Palate Designs, LLC.

Fresh Flowers – If you intend to use fresh flowers on the cake, you must obtain your flowers from an outside reputable florist. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. The person placing this order should obtain a notice of plant safety, in question, from the florist. I will carefully wrap the stems before placing them on the cake. You assume all liability and responsibility for the condition of the cake altered by anyone other than Cake Palate Designs, LLC.

Deliveries  – Scheduling delivery services are on a first-come basis and are made on the date and time specified on your order form. The delivery time will be confirmed two (2) business days before your event date. Please ensure that you provide updated contact information and an alternate contact person and number if I might need to notify you of any situation that arises or occurs. If the delivery address changes after the order has been confirmed additional charges may be added to cover extra mileage.

 

You must provide clear driving directions to agreed-upon delivery locations, given that Google Maps or other GPS applications may not be accurate. Please be sure someone is onsite at the time of delivery. If there is no one on hand to receive the order, we will wait 30 minutes maximum before leaving. Once someone becomes available, a late delivery charge of $50 will be due immediately before the order is released. If we leave the premises unable to deliver the cake, you or your designated representative will be responsible for picking up the cake from our location. A late delivery charge of $75 will be due immediately before the order is released. We close daily at 8:00 PM Monday through Saturday and are closed Sunday. Any order not picked up by close of business is forfeited, and no refund, future credit, or date changes are permitted under any circumstances. Order(s) may be donated to charity or resold at the discretion of Cake Palate Designs, LLC. There are NO REFUNDS or future credit given that I attempted to deliver the cake. A delay in Cake Palate Designs, LLC transit shall not constitute grounds for a discount or refund.

 

Cakes may be set up 1-3 hours before your event. For outdoor events, I try to set up as close to the reception time as possible, which may limit design options. The minimum delivery and setup rate is $75.00 in the Tulsa metro area. Outside the Tulsa metro, it is the $75.00 fee plus $0.62 per mile from my location to the delivery address roundtrip.  

 

A bridal cake must be purchased and scheduled for delivery to have a groom's cake delivered.

 

Disclosure – The client must disclose any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished products. Refunds requested due to imperfections caused by weather, heat, humidity, rain, snow, sleet, ice, freezing rain, labor disputes or strikes, inclement weather, transportation problems, illness, or other factors beyond our control will not be honored. In the case of an unavoidable occurrence, such as an act of God, a car accident, poor road conditions, or the dropping of cake during delivery — Cake Palate Designs, LLC cannot be held liable for more than the price of the cake described in the order. That amount will be issued to you within seven (7) to ten (10) business days.

​

Fail to Deliver – If Cake Palate Designs, LLC, or its representatives, fail to deliver or have your cake ready for pick-up on the agreed-upon date and time as outlined in your contract but not including catastrophic events or acts of mother nature forcing pick-up or delivery at a later date. You will receive a full refund of all monies paid.
